1. Introduction and Acceptance

Welcome to Desert Rise Real Estate (“Company”, “we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website https://desertriseuae.com/ (the “Site”) and our related services, including our property listing platform and subscription packages (collectively, the “Services”).

By accessing the Site, registering an account, or purchasing a subscription, you agree to be bound by these Terms. If you do not agree to these Terms, you must strictly stop using the Site and our Services.

2. Definitions

  • “User” refers to any individual or entity accessing the Site.
  • “Seller/Agent” refers to a User who registers an account to list properties for sale or rent.
  • “Buyer” refers to a User who registers an account to search for properties or contact agents.
  • “Content” refers to text, images, video, and other data uploaded to the Site.
  • “Subscription” refers to the recurring paid access to specific features of the Site (e.g., unlimited listings, featured spots).

3. Account Registration

To access certain features, you must register for an account. You agree to:

  1. Eligibility: You must be at least 18 years old and capable of entering into a legally binding contract under UAE law.
  2. Accuracy: Provide true, accurate, current, and complete information during the registration process.
  3. Security: Keep your password confidential. You are fully responsible for all activities that occur under your account.
  4. Notification: Notify us immediately at care@desertriseuae.com of any unauthorized use of your account.

4. Subscription Plans and Payments

Desert Rise Real Estate operates on a subscription model for specific user tiers.

  1. Fees: Fees for listing packages or premium buyer features are displayed on our pricing page. All fees are quoted in UAE Dirhams (AED) unless stated otherwise.
  2. Payment Processing: We use third-party payment processors. By providing a payment method, you authorize us to charge the applicable fees.
  3. Renewal: Subscriptions may automatically renew at the end of the billing cycle unless cancelled.
  4. Cancellation: You may cancel your subscription at any time via your account dashboard. Cancellation takes effect at the end of the current billing period.
  5. Refunds: All fees paid are non-refundable, except where required by UAE consumer protection law or at our sole discretion in cases of technical error.

5. User Conduct and Listings (For Sellers/Agents)

If you post property listings on Desert Rise, you agree to the following:

  1. Ownership: You represent that you are the owner of the property or a licensed real estate agent with valid authorization (e.g., Form A) to list the property.
  2. Accuracy: All listing details (price, location, size, photos) must be accurate and kept up-to-date. Sold or rented properties must be removed or marked as such within 72 hours.
  3. Compliance: You agree to comply with all regulations set forth by the Dubai Land Department (DLD) and the Real Estate Regulatory Agency (RERA).
  4. Prohibited Content: You may not upload listings that are fake, misleading, duplicate, or contain offensive material.

6. Intellectual Property Rights

  1. Our Content: The Site code, design, logos, and text created by Desert Rise Real Estate are our exclusive property and are protected by UAE and international copyright laws.
  2. Your Content: You retain ownership of the photos and descriptions you upload. However, by posting them, you grant us a worldwide, royalty-free, perpetual license to use, display, reproduce, and distribute your content for marketing and platform purposes.

7. Prohibited Activities

You agree not to:

  • Use the Site for any illegal purpose or in violation of any local, state, national, or international law.
  • Scrape, spider, or use automated means to access the Site’s data.
  • Attempt to bypass any security measures of the Site.
  • Harass, abuse, or harm another person or group via our communication tools.

8. Disclaimers and No Warranty

The Site is provided on an “AS IS” and “AS AVAILABLE” basis.

  1. Intermediary Role: Desert Rise Real Estate is a technology platform. Unless explicitly stated otherwise, we are not a party to any real estate transaction entered into between Buyers and Sellers.
  2. No Guarantee: We do not guarantee the accuracy of User-generated listings, nor do we guarantee that a property is available or that a transaction will be successful.
  3. Availability: We do not warrant that the Site will be uninterrupted, secure, or free of errors or viruses.

9. Limitation of Liability

To the fullest extent permitted by applicable law (including Dubai and UAE Federal Laws), Desert Rise Real Estate shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages.
  • Loss of profits, revenue, data, or use.
  • Damages resulting from your access to or use of (or inability to access or use) the Site.

In no event shall our aggregate liability exceed the greater of AED 500 or the amount you paid us in the past six months.

10. Indemnification

You agree to defend, indemnify, and hold harmless Desert Rise Real Estate and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with:

  • Your access to or use of the Site.
  • Your violation of these Terms.
  • Your violation of any third-party right, including intellectual property or privacy rights.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Emirate of Dubai and the United Arab Emirates.

  • Dispute Resolution: Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Courts of Dubai.

12. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Site. Your continued use of the Site after the effective date of the revised Terms constitutes your acceptance of the terms.
